Can i ask my father to give me my share from his property

18-Oct-2023 (In Family Law)
My father is selling his property of 3 acres of agricultural land. He has got into an agreement with a buyer and the agreement is registered. The buyer is delaying the registration purposely and not getting back. Since i am in need of money , can i ask my father to give my share of the property so that i can use it. Can he distribute the property among his 2 children ? In that case what will happen to the registered sale agreement. We wanted to know wheather my father can give us share. Will registered agreement stop this. Please suggest.

Dear Sir,
when a registered agreement to sale is entered upon by your father and a buyer, meanwhile dividing the property and alienating the same would be a breach of that registered agreement. until and unless that agreement to sell is terminated. please look into the termination clause and see if the same can be terminated and how and then on clearing your liabilities with the buyer, please go ahead and do the partition of the property.

Whether you were party to such agreement, what is your and other sibling age,
whether property is self acquired or ancestral
whether document/agreement disclose any time frame
these are few points which will help you to understand whether you should go for what action
meet lawyer and discuss in detail, you'll get solution.
May settle issue through mediation /pre- litigation level
