Can father be restrained to meet his child after divorce wihe custody

My, friend has a son and she is divorced, she has the custody of the child, but the is being constantly visited by her father and his family at his school and they even take him out of his school at times causing a disturbance in his studied and giving the child a mental distress and causing him not to concentrate on his study. and this happens very often for which the mother has received several complaints from the school. She is willing to let the father meet the child but not at some odd time and at the prescribed time by the court. please guide us.

Hi. The terms of visitation of the father would depend on terms ordered by the Court while granting custody to the Wife. Any violation of that order on visitation would be tantamount to contempt of court. Appropriate proceedings can be initiated to restrain the husband from acting contrary to the order.

Dear Client, in this case you have an option to file the change of Parenting time, one parent can ask for a change (modification) of parenting time or if both parents agree on the change, they can request the change together. The modification forms are usually filed with the Probate and Family Court where the judgment/order was originally issued.

Yes he can be restrained to. Meet the child but you did not disclosed the condition mentioned in the settlement between both if tere is condition permitting father for visiting right then also he can be restrained you will have to consult lawyer personally with all document pertaining to your case thanks for query
