Can a step son claim for property by his father after separation

My parents have been living separated since 2014 by getting divorce by a competent court.The reason was that my father was living with his second wife illegally.This matter has already been decided by family court. But the question is that.... Can i claim for property from my father as a class one heir?

After the husband divorce his wife before the court then wife is not interfere in his personal life.1st you say is the wife claim for maintenance in her divorce case?because time limit was gone ,however if you say what is order of the court then I think what can I do .

As per section 15 of hindu succession act you are eligible to claim share from your father's property, if it is the ancestral property. Your father has got every right to transfer the self acquired property to any one as per his wish.
And secondly you have to confirm that at the time of divorce whether any mutual agreement was executed by your mother not to claim any share or maintenance by her or the legal heirs in future. For more details feel free to contact me I can help you.

Yes even his illegitimate son has right over his ancestral property.File a civil suit for partition in the competant court.Find out his present offspring and even your sibling can demand a share.Your mother might have settled on her right.

Yes , son or daughter may legitimate or illegitimate has properly right . If you are son of legal married wife then you have right in ancestral property but during life time of your father you cannot claim share from self acquired properties of your father

dear mr
dont worry if you are the biologycal son of your father then you can claim for property from your father through court of law your father can not deniy to give your share from his property .
