hello sir/madam, Can a married woman leave her husband if she is not willing to stay with him. If she file for mutual concern divorce and her husband is not willing to give divorce to her, but she wants to get remarry another person as soon as she gets divorce.

Hi
A mutual consent divorce should be filed by both the parties.
The women has to file a divorce and then the husband can contest the same.
Today the woman can file a 498a, Domestic violence case etc to ensure that these cases add pressure on the husband and express his consent for mutual consent divorce.
the lady can marry after 90 days from the date of obtaining divorce decree.

Dear Client,
A married woman can leave her husband if she is not willing to stay with him. She cannot file a petition for divorce on mutual consent when her husband is not willing to give divorce. She cannot marry without getting divorce from husband.
