Hello
We have Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for the protection & maintaince of parents & senior citizens. Since you have already approached the tribunal and 4000pm is ordered. You can again appeal to get the amount increased. Lot of factors determine the amount of maintaince like what is the income of your brother. What all property on his name.
According to me a new case should be filed against your brother under
Section 125 (1) (d) of Code of Criminal Procedure, 1973 is a provision in Indian Law whereby a Magistrate can order children to make a payment of monthly allowance as maintenance to their Parents (father or mother). But i need to see the copy of the tribunal orders and the financial condition of your brother.
