Brother having love affair with married woman is it illegal

hello sir/madam, this is laxmi my religion is Hindu and my problem is my brother having love affair with a married woman who have one child and also she married 2 persons without having divorce and her age is 33 my brother age is 25 my brother is unmarried person my family don't like her because we have done Enquiry for her finally my family decided that she is not good for my brother but my brother want to marry her and that lady also ready to get marry my brother but we are trying to convince him from last 4 to 5 months but he is not listening my mother words we are facing very hard situation now is there any possibilities to seperate my brother and that woman please help me because i want brother with out her please can any body give me a reply
Firstly an affair with married woman by your brother is illegal and not permissiable. If that situation wants to be legal and if he wants to marry, first of all she has to obtain divorce decree from the legally wedded husband. As your final conclusion is that for resolving the problem, to separate your brother from her by disconnecting the mobile connectivity and other modes by keeping him for away from her place. But now a days there are several modes to contact a person. So firstly you try to change the mind set of your brother and give a strong caution to the lady by filing application/complaint before all authorities like police. O.K.

You cannot stop any person including your brother to marry. But you can see whether it is proper under law. If that lady give divorce to her present husband she can marry your brother. You can convince your brother to ask her to take divorce from her present husband before marry her so that no legal complications will crop up.

Since the lady has not formally obtained divorce , any subsequent marriage of your brother with the lady will be NULL and void in the court.
So in this context, the best way to separate your brother and women is to ask the lady to formally obtain the divorce from the court in the first instance. Any divorce proceeding will take atleast 12-18 months and hopefully in this period your brother might change his mind.
