Are live in relationships considered as marriage in India?

I have been in a relationship for more than 10 years. past three years we were in a live in relationship. now she has moved to her hometown and she is refusing to come back to me and continue the relationship. Is there any ruling which talk about live in relationship to be treated as marriage ? please help me

It would depend on how the relationship continued for 10years. If you have lived as husband and wife for 10years and the society has also recognized you and her as the husband and wife, then considered as the marriage and also other factors need to be considered. If she is refusing to come back you can seek restitution of conjugal rights.

You can file an application for restitution of conjugal rights under the provisions of different enactments, but the law did not approve your relationship. But the the Apex Court recognized your relationship. But it is very hard to prove such relationship. You may try and if you are successful, then it well be a new ruling for such relationships in India.

The live in relationship over a period of three years by woman has to be treated as a de-facto marriage. He can enforce her to join again on compulsion. If she voluntarily join there will be no issue .
