Amount transferred from joint a/c to my brother's a/c without consent

My elder brother is 12yrs elder than me. When I was only 2yrs old my father died. When I was 11 my brother initiated selling out our house that was registered in my mother's name, with my mother's consent. And, the money that came from that sale was deposited in a joint a/c in my elder brother's and my mother's name. The a/c was operational as both party signatories. And my brother then transferred the whole amount to his own a/c from that joint a/c with both my mother and him signed a cheque. we didn't expect that he would cheat us by not giving anything later on. can we get back our shares?
