Whether electronic emails would be used as evidences or not?

Kindly clarify whether the CD containing the original electronic emails filed on tendering evidence would be an EXHIBIT Evidence or not?
Yes, digital evidence can be used in a court. You need a special affidavit drawn up under Section 65B of the Indian Evidence Act. Electronic records are treated as documentary evidence for all practical purposes. However, you must be able to show safe custody and authenticity of the data.
