What you first need to consider is whether you want your firm to be a regular partnership or a limited liability partnership (LLP). The advantage of incorporating a LLP is that it would protect your personal assets in the event of a dispute. Most law firms have moved to this model after it was introduced in India.

To register a Indian LLP, you need to first apply for a Designated Partner Identification Number (DPIN). You would then need to acquire your Digital Signature Certificate. Thereafter, you need to get the LLP name approved by the Ministry of Corporate Affairs. Once the LLP name is approved, you can register the LLP by filing the incorporation form with the Ministry.

For a regular partnership, have a partnership deed drawn up by a competent lawyer and have the same registered. If your partnership deed is not registered it becomes impossible for one partner to enforce his rights through the Courts as against the other partners.
