You can file mutual consent divorce. Or You can file divorce on the grounds of desertion by your wife. You can make a settlement for permanent alimony but without divorce it would cause future problems. MOU is like any other agreement. It has to be written in a a Rs.100/-stamp paper. The registration fee would be Rs.1000/-.

Dear Client,
You must file a petition for divorce and in that case there is step for counseling in mediation centre. There you can opt for compromise ask the authorities to refer the matter to Lok Adalat for settlement. In Lok Adalat a Judge will grant Lok Adalat Compromise Decre which is binding on both the parties to the proceedings and will not be modified even in High Court. In drafting Compromise Decree in Lok Adalat you will seek the judge to insert the terms and conditions. You can insert conditions like receiving permanent alimony, not claiming any future maintenance etc by the wife. After passing of Lok Adalat Decree you will be given a copy of the same and you may retain the same. It will not be challenged by her in future. If MOU is drafted the same conditions will be inserted in Lok Adalat Decree. You need not pay any stamp duty then.
