17-Mar-2023 (In Documentation Law)

1.In the SLP format given in the SCI website, one has mark Petitioner as A and Respondents as B,C,D,E,etc. Can I number the respondents as R-1,R-2,etc? 2 Can quashing of FIR and chargesheet under S 482 Cr.P.C. be prayed as interim relief, as I have go abroad soon. Can This interim relief be shown in SLP itself as Interim Relief or a seperate IA has be filed.? 3. Do I have to enclose copy of WP against the order of which I am preferring SLP? 4. How should the lines to be spaced (in double line spacing?) and what about margins- left side, right side, top, and below in SLP & Annexures of SLP

If you are filing a Special Leave Petition, which is preferred before the Hon'ble Supreme Court, you would require an Advocate on Record (AOR) to enforce the petition. AORs are specifically trained to file petitions before the Supreme Court and are well versed with the rules. Respondent's may be numbered as Respondent 1, Respondent 2 etc.

Quashing of the FIR is not required to be prayed for as an interim relief as Section 482 is a power that is exercised only by the High Court. However, if the SLP is admitted then an interim relief of stay over the proceedings emanating from the FIR may be prayed for and granted by the Hon'ble Court. This would essentially have the same effect that you require. There will be a stay on the FIR and notice will be given to the respondents.

You are not required to enclose a copy of the entire Writ Petition. The text should have double line spacing and font size is 14 and the margin to the left should be 4cm and 3 cm on top, bottom and right for all pages. Annexures should be typed and translated if required. If you urgently require relief it would be best to engage an AOR as there will be several office objection on the petition which will have to be removed before the matter is listed before court.
