How to get property left by father

My father has expired and he has property. And we are total 4, mom-51,sister-22,me-20,brother-14. Can I get details on how to claim the property and the process of claiming in detail. Thank you.

Information is insufficient to answer the query. What is the nature of the property. Whether it is self acquired property of your father or it is the property got from his father that is from your grand father. If it is self acquired property of your father, then all of you will have equal share. If it is the ancestral property of your father, then you three will get one fourth share except your mother plus one fourth share in your father`s share including your mother. Engage an expert advocate and file a partition suit for getting property share by metes and bounds.

Firstly you ought to disclose to which religion you observe/follow. The property left by your father can be divided among you all either by family partition which can be registered with SRO Concern. Or you can approach the civil court for partition of said property and it's division. In the later case you have to approach a lawyer to put up your case.

Response:
You apply for the death certificate of your father from Municipal authorities. You should also get legal heir certificate from the Civil court evidencing that you four persons are the legal heirs of your father.

Once you get the above two documents, you are deemed as the owners and you can even sell the property to third parties.
