you need to obtain a NOC from the court that the court has no objection in case the passport is issued to you, once you obtain the NOC from the court where your matter is pending that NOC can be presented to the Passport office and then the Passport office would issue you your passport. Usually the passport office is reluctant in issuing passport in case any criminal matter is pending.

Please log on to passportindia.gov.in whereby guidelines and undertaking format has been prescribed for those persons against whom criminal case is pending. You are required to supply a copy of the undertaking proforma with the details of the proceedings pending against you and stating that you shall appear before the required court as and when required.

This is in addition to all the documents which you are ordinarily required to supply with Passport application.

You can track your passport online or through email. If still you are not successful, you should send a legal notice from an advocate and thereafter if necessary file a written petition in the high court.
