Can mother give consent to sell on behalf of her mentally ill child

Property is registered in mother and her two children's name out two children one is mentally ill, if they want to sell property can mother give consent on behalf of the mentally ill child.

Yes, the mother can give consent to sell the property on behalf of the child who is mentally ill. The reason that she can consent to sell the property is that the child who is mentally ill is insane and incapable of understanding anything. If the situation would be reversed saying that the child is sane person then in such case the permission to sell shall be given by the child himself and not the mother.

Yes, but it would be if applied through order of court. Please provide registration documents in order to ascertain all clauses mentioned in the document to give you a better clarification as the same will provide whether we need to apply to court for the same or an affidavit will suffice the purpose
