Being legal heir can we claim sister's PF and house after her death

22-Feb-2023 (In Documentation Law)

My sister expired Aug 2015 with Cancer. She is divorced and has not met her husband or son for the last 18 years who is 28 years of age. Both son & husband did not come for her funeral . We, her siblings took care of her during her illness. She was working as a lecturer. She also owns a house in Bangalore. For her PF she had nominated her father who expired in 2007. She also did not make a will for her property in Bangalore. My query 1) what is the process to claim her PF and other entitlements from The college has asked for legal heirship certificate to settle the PF etc.

Sir,
u can get a direction from court.

As per PF Office : In Death cases:
Nominee/legal heir should apply in Form-20 / Form-10-D / Form-5IF.
If the member has not executed any nomination, application should be supported by certificate of family members issued by employer / revenue official / sworn in an affidavit by the family / member/legal certificate from a court of law.
Death certificate of the member.
Certificate of the employer stating whether the death was while in service of the member or not.

Your sister's legal heirs are your father and mother, so your father and mother are entittle for the monetary benefits available to your deceased sister. You said your father is no more then your mother is entittle to claim.
