Dear Friend,
Please understand that divorce by mutual consent is only verified after Court order. Your mutual understanding has no validity when you are applying for govt. documents. Do the following-
1- Have a valid divorce through Court. File a divorce by mutual consent if your ex-husband agrees or file it for other reasons.
2- Decide the issue of custody of the child.
3- It is only after you are legally divorced and have court order for custody of child, that you do not need your ex-husband's signature.
