Wife stole my cheque book & the divorce is going on.

I have lost my cheque book few month back and somehow my wife has deposited one cheque in this account so can I take legal action against her, considering the fact that our divorce case is going on? Kindly Advise?

first she has to prove that how she used cheque if you are not to paid any amount to you wife for tht how she can used you cheque and she has to prove also all this thing to court but you have benefit for this in that you can do just show all this in your domestic violence case that your wife doing such thing for money nothing else.

You have not stated whether the bank account is joint or only in your name. Inform your bank of such developments in the meantime so they do not clear any such cheques. If the account is only in your name then I am assuming that you had either signed all the cheques or that she had signed on your behalf.

If she has blank signed cheques then the only course of action would be to have the payments stopped from your bank. You might want to close your account depending on what is at stake.

If she had signed on your behalf then several criminal offences would be attracted and you could file a criminal complaint.
