Wife not ready to live with me or divorce me

Dear sir, my wife z not living with me since December 2015 till date and says will not gt me out frm the marriage. I hv a son aged 4+ living with my wife. We both husband and wife are Central govt employee but she z gttn more as per pay band and grade scales. My mother in law z the one fr all this paranoid.

You can file for restitutional of conjugal rights and ask the court to direct her to live with you. So that all of you can live together. If she denies then go for mediation and ask for divorce. If you need assistance to get this done you could contact us.

You may send a notice under section 9 of the Hindu marriage Act 1955 for restitution of conjugal rights and after the expiry of notice, you ma file a petition under section 9 of the Hindu Marriage Act for restitution of conjugal rights . The term " restitution of conjugal rights means " If either the husband or the wife, without reasonable excuses, withdraws from the society of the other, the aggrieved party may approach the Court for restitution of conjugal rights."

well as per your query you are legally weded and wife is not cooperating with you so you can file a petition for section 9 of Hindu marriage act for restitution of conjugal right and for that you can

You have to decide whether to carry on in this relation or you want to finish this relation . if you choose to carry on then file suit under section 9 of HMAct n get her back by virtue of legal order . if you choose latter one then file a suit for divorce on the grounds of federation clubbed with cruelty etc n part away legally .
Next custody of child you can file application for custody of child n court after considering over all welfare of kid will decide either way . so take call either way . make up or break up is your choice n guided by circumstances surrounded with you .

You can file a divorce case. On grounds of separation for 2 years. Further you can fight for child custody too.
