my matromonial completed 7years. my wife has an affair before marriage to til date. Now she is not live with me she leave my home & live together with his boyfriends home as a wife an husband . i have a 4 year daughter. i asking her for give me a divorce but she refused. she takes a advice of 2-3 advocates. one day her advocate call me & tell me we will file 125 against with you. I can told advocate you can't do this. thereafter he is balck mailing me otherwise she is fill 498 against you .fistly which action take against her
you can file biggmy offence against her boy friend for having relationship with your wife without your consent. The you should give notice to your wife u/s 9 of hindu marriage act for restitution of conjugal right as per law. If you give notice through lawyer about the threat given by lawyer then you will get benefit of doubt. That your wife is taking undue advantage of 498 this will directly benefit you. About maintenance there is long court procedure to get order implemented.
