Wife is not wiling to give divorce but her family interfering

23-Dec-2023 (In Divorce Law)
I don't want to stay with my wife and we have no physical relation since last 5 years. I want to go for divorce but my wife is not willing to leave me. We have a kid(5 years old) and she uses her as a medium to stay together. After marriage her family interfered in our daily life and I explained this to her earlier but she ignored and things got worst. She don't want to opt for divorce just because her parents are not allowing her to do so. Her parents does not want her to live with them and she is completely dependent on them. Her parents treats her very badly to avoid her presence at their home.Being aware of these things she do not want to go for divorce against their wish. I would appreciate if you can give me a solution.

Better to file petition for divorce on the ground of desertion and prove the desertion as well. If she is not ready to give u divorce due to influence of her parents. If her parents are treating her badly just she should not take divorce from you and it may be intention of her parents that is she got divorce from you, she will only depend upon them. Then be ready to make the alternative arrangements for her stay like seperate home for her.

Hi

You can proceed before family court for divorce petition.
You have to contest the said matter i.e. it will go one sided and it will be decided on merits of the case.

see thinking about the future of your kid, you should give your marriage a second chance. It would be advisable if you opt for a marriage counseling, which would be helpful for u, your wife and the most important is your kid. I would like to state that for better future of your kid you should give your marriage a second chance.
