Wife is mentally ill can I seek for divorce

24-Sep-2023 (In Divorce Law)
I live in Bangalore & got married 1 Yr 10 mnths before. Wife belongs to Ranchi,Jharkhand. After marriage I came to know that she has mental illness & she have been taking treatment from last 6-7 years before marriage. I contacted my in-laws & asked for the previous medical documents, they refused to give & said, there is no problem & no documents available. Thenafter, I stopped talking to my wife's family. I consulted to NIMHANS hospital Bangalore & started her treatment, doctor also called her parents to discuss about her past, but her parents never came. Doctor confirmed that she is having Bipolar Disorder & cannot be permanently cured but can slow down with medicines only. Wife always fights, shouts, abuses & using slang against me which a husband cannot expect. I & my family always supported her & tried to make her cured, but still she always insults me & my parents & threatening us. My life became hell. Doctor also said, it is very risky to have baby also in this disease. Plz help

Dear Querist,
It is sad that u r wife is suffering from Bipolar disease, keep the diagnosis report carefully, you can file a petition for divorce on the grounds of cruelty and that your wife and her fly members have suppressed facts that she is suffering Bipolar disorder and that the same cannot be cured, along with it you can also prepare the petition that she is very abusive and that a normal life cannot be lead and therefore u can ask for dissolution of marriage .

Dear Sir,

Yes you can claim divorce on the grounds of insanity. A divorce based on one spouse's insanity can quickly become an uphill battle. You bear the burden of proof in your divorce, and a judge will require a substantial amount of evidence in order to confirm your spouse's mental illness. To prevent a judge from dismissing your case, you’ll need to gather your spouse’s psychiatric and medical records, reliable witnesses, and even experts that can testify about your spouse’s condition.

Mental disorder can become a ground for filing a divorce if the spouse suffers from incurable mental disorder and insanity and therefore it cannot be expected from the couple to stay together. You need to prove that the mental disorder is standing in the way of a happy married life and affecting your health and career.
