Wife is earning, how to get proof for the same for maintenance case? She is working in a govt. school and has given the school's address in passbook for records

If wife is working in government school and earning, first of all she can't deny to her earnings in court. If she is denying, we may get information of his salary with RTI, mentioning his name, rank and posting school station.

You can file the copy of the ITR , and also take out her account statements. You can file an RTI for the same if you the school in which she is working. If she is denying in the court that she is working as a govt. teacher,this amounts to perjury as per the Indian Penal code.

Approach the District Education Officer concerned through RTI and request him to furnish service statement of your wife for last one year. There is difference of judicial opinion whether an earning wife is entitled to maintenance or not, hence, send me a copy of application for maintenance filed by your wife for proper legal advice.

well she is working in gov't school.. her pay slip is bigges proof. if you dont have one summon someone from her school with records. that will definatly help you in your mainyenence case. since you have given no more details so that conclude the query..

You may file RTI application seeking her income details, though any such response may be resisted by her department, as it relates to personal information of an individual. You may move an application to summon her employer/District education officer, with records related to her employment including her income . In additional if your wife has filed application for maintenance under section 125 CrPC, you may also move an application requesting Family court to direct her to produce her income & salary documents.
