Wife is causing mental cruelty how can I file for divorce?

I was married 5 yrs back but my wife dosnt stays with me... more than 50% she like at her mother place... earlier she left home & came back after 4months immediately after marriage then again she left home & cam after 1.5 yrs by saying sorry ans shall not repeat. She is house wife & we have maid also at my house. we are just 4 at our house. can i know how do i proceed for divorce

Sir there are two ways of filing divorce. One is contested divorce and the other is a mutual divorce. Contested divorce is the one where husband and wife cant mutually decide on maintainance, child custody etc.. And for that they engage in a legal battle. This battle can go on for 2 to as many years as you would want to prolong. Mutual divorce on the other hand is a shorter less expensive process where both husband and wife pre decide theor issue and within 6 months minimum the matter can be decided. Hello, A Husband is entitled to seek divorce or judicial separation in case the wife is living away from him without any reasonable cause. However, the wife should be living away from the husband for a continuous period of not less than 2 years, before any petition for judicial separation or divorce can be filed. You can file a case for divorce for mental cruelty
Engage a advocate who will Send a legal notice thereafter file a divorce petition.Prtition can be filed at the place you are residing/got married/last cohabited.
If your wife agrees for divorce you can go for mutual divorce which will take 6 months.incase she contests then 2-3 years.
