Wife has filed false FIR and wants marriage to be dissolved

My brother's wife is not willing to divorce and she has theft gold ornaments of which we dont have solid proof other than missing. She has put many false allegations on our family including dowry. Their family was agreed to dissolve the marriage by having money of 21 lakh and on which we gave them 5 lakh has to proceed but they didnt agree and kept 5 lakh and now they are asking another 16 lakh in cash and they want the marriage to be dissolved without any legal seperation. Please advise

No Marriage can be dissolved without legal separation. Without getting a court's decree/order of divorce, no husband and wife can be considered legally separated. These kinds of settlements which the opposite side is asking you to go into are not maintainable and not even reliable. Dear sir,
Firstly if they are agreeing to settle the dispute then settle it. If not then apply for bail immediately, however it is advisable that if she withdraws her fir it will strengthen your case.
Rest you can dissolve the marriage by mutual consent.

It is not advisable for you to pay any amount to anybody as of now. At this stage if any FIR is registered against you or your family, you are advised to move a bail application before the competent Court. After this, you should contact the concerned police officer (Investigating Officer) to file a closure report in your case as the allegations imposed upon you or your family are baseless and false. On the other hand, you should file a divorce petition before the concerned Court and if any alimony has been decided by the Court, deposit the same before the Hon'ble Court and do not give anything in cash or off record.

Sir. It is nothing more than your or family members expoitation. Needless to say that such kind of transactions has no legal value as wel as it is not going to help you in future. Advisable that you should drfend your case before the court and avoid to give asingle penny without court's order if any.
