Wife filed false case against me can i use at ground of divorce

Wife is not giving divorce and not want to negotiate.We both are government employees and have job now How to get divorce as I want divorce and filled it after my wife filled an FIR against me and my mother brother sister and have the IPCs 498a/406/307/328/34/497.I am in Anticipatory Bail now and my brother sister mother also.Police have raid 200gms gold of my wife from us My son is also in favor of his mother.What can I do now.
On the basis of FIR you cannot file for Divorce. You can separately file for Divorce under section 13 of Hindu Marriage Act. Section 498a IPC is a criminal case which is separate and divorce matter is separate which can both be taken up simultaneously in the court . Divorce matters are taken by family court. What ever your wife is entitled to she has the right to take it back or get it. Kindly be sure there that what ever your wife takes from your home you note it and obtain the signature or her and have some witness in it. In case she refuses in court that you have not given her the belongings of hers which will be difficult for you to prove then.
