Wife demanding residential property in exchange for divorce

17-Aug-2023 (In Divorce Law)
Me and my wife have stayed apart for the last three years, and now I want to get separated as there has been a complete breakdown of compatibility and rapport. I have expressed this desire to my wife who is demanding a residential property, in exchange for signing the papers. She says we can stay apart till I fulfill this demand, and then we can separate. What options do I have in this case? I want to get separated as early as possible, so that I can move on with my life. Thanks

If she is very adamant in her demand then i suggest you to file a contesting divorce case under which you have got few grounds to approach the court of law. Later if she realise the same, then you can settle before the court by way of filing the compromise petition.

You can offer lumpsum amount as permanent aliomny, or you have to give the property, if you want to get divorce easily, or you have to file divorce petition against her prove grounds of desertion or cruelty and get divorce and also pay maintenance as ordered by court.

In case of mutual divorce lots of things are required to be discussed and negotiated. It is better to seek the help of lawyers to help you to obtain some kind of settlement. There are various aspects of financial settlement which includes alimony, maintenance, house, education expenses of children if any, stridhan, joint investments, joint accounts and many others. If you cannot come to clear conclusions you may seek the help of a lawyer to negotiate on your behalf to reach a balanced conclusion.

As she is not cooperating for divorce through mutual consent (when both parties mutually decide to part ways), you can file a case for divorce under various grounds. I advise you to file a case for divorce and seek a settlement in it where you and she can negotiate with the assistance of your respective lawyers and try to arrive at a mutually amicable settlement.
