Wife absent from second motion of mutual consent divorce, what to do
25-Mar-2023 (In Divorce Law)
Hello Sir, I need your advice in 13B case which is in process at District Court. My wife & I have filed it on ground of comprise deed. First motion was in August'15 but she didn't turn up on second motion and raising her demands now even when it is clear in the affidavit we filed that she got everything back and nothing is left now. She is not turning up in the court and I've nothing left to give her now. they carry goons along with them as place wherein they filed the petition is far away from our matrimonial place and is local to them. We are not having any baby and my wife is working in an MNC and earning very well. What can be done by the court in this case? Can court allow me divorce considering her ex-partee if not how can I get rid of her asap. I really need your valuable advice. Please do reply. Thank you.
First of all talk to your wife once again regarding coming to the court, secondly if she does not come to the court then you have to file a contested divorce Thirdly what you can do is that a you can file you can file a case against your wife for breach of contract.

First motion and second motion
What happens when in mutual divorce in second motion one person is not coming for sign
wife not coming for second motion
Can wife withdraw mutual divorce petition after first motion has passed
Now personal presence not must for divorce by mutual consent
What happens after second motion
If she has not.moved application for withdrawal from the case you can get decree of divorce. Otherwise you can file petition for divorce. If she is earning more than you, you can claim maintenance from her

Hi,
In the case she did not appear for second motion to give her consent, she can not be forced. You can get someone, advocate or the peerson who mediated and got the intraction to mutual level. If it does not work out, you will have to file a case on the ground of cruelty/desertion. Please contact lawyer.
