Who decide the terms and conditions under mutual divorce

Petition is filed by husband through contested divorce but nw he is asking for.mutual consent so want to knw who needs to provide the terms either a wife or husband or both needs to provide the terms simultaneously. My son is of 4 yrs and I am working so he is taken care by my husband and mother in law. But after divorce I want the custody of my child so what r the procedures for the same and since I am earning wht expectations I can keep on myhusband for alimony or maintenance

Dear client first contested divorce petition needs to be convert in mutual divorce. Both husband and wife jointly submit memorandum of under standing of agreed term about alimony child custody. For any legal help call me

Terms for mutual divorce should be decided by both the parties according to their mutual understanding. For your son also you are required to make a note in consent terms that child will be in custody of mother. It will be enough. In case your husband is not ready for it than mutual consent terms will be in vain and you have to file different application for custody of child. And last important thing if you are earning then judge will be reluctant to give you maintenance or alimony. You will have to prove why you want alimony or maintenance
