Where we have to file divorce & how much time it will take

As we both are hindu but our caste differs , she is from SC cast, We got married 8 months ago, due to some issues between my wife & my mother she want's divorce from me, When her mom takes her from my home she was asking me to get seperate from my parents I got agreed with that but then also she is not coming back now she asking for divorce but not prearing any papers nor she is asking anything else, please suggest what to do ?

You both can file for Divorce by Mutual Consent in court.
The court will look into the petition and after completing the legal formalities and procedural aspects the court will grant divorce you..
If she is agreeing then there won't be any problem and within short time you will get Divorce.

Within one year of marriage no divorce petition is maintainable.
You can wait for four months or Elise you can move an application of nullity of the marriage.

if you want to live with your wife you can send a notice and file a suit for restitution of conjugal rights or if you want a divorce you can file a suit for divorce in the court of law it depends upon you what to do ?? but do it as soon as possible she can file other complaints against you under domestic violence etc so please do it as soon as possible.please contact your local lawyer for further advice.

it will take six months to get divorce. but before that i need some information i.e. whether the marriage was registered ? where the marriage has taken place ? where the parties herein residing as a husband and wife

hi i have been through your query and yes you can file a divorce after 12 months has passed after your wedding and it can be under Sec 13 of HINDU MARRAIGE AND DIVORCE ACT and it can be contested or it can be mutually done depending upon the both the parties!
