Where to file the case for domestic violence?

My sister has been facing mental torture and harassment by her husband since past 3-4 years. From the very start, he has been telling her that he doesn't want to live with her and is dragging the relation. He shouts at her and does not even talk to her for days at a stretch. She works in a pvt firm and lived with her husband in Mumbai but a month back came back to her parent's house in Bhopal. He had been abusing and torturing her continuously. She is so mentally disturbed that she is slowly moving towards depression. Also, since the time she moved out, he has not even inquired about her. Can we file a Domestic Violence case against her husband? Can the case be filed in our hometown or do we need to file the case in Mumbai itself?

You can file case of domestic violence act against your husband and any other family members if they lived with them. You came can file this case either in Mumbai or in Bhopal. But it should be carefully drafted to invoke jurisdiction of Bhopal. You can get drafted your complaint through mail.

Hi, Domestic Violence case can be filed in either place Mumbai or Bhopal as it is a continuing violence. You can contact a local lawyer and provide him all the details for the same. You can also lodge an FIR under 498a IPC for cruelty.

Your sister may file a case at the marriage place or at mumbai. Both jurisdiction are valid to file a case of domestic violence. Your sister may file a complaint case before the magistrate court..
