What is the procedure to take divorce

I got married in 2011. Since then its hardly been 3-4 days wen we have been together. Although I hv two kids in between those days only. But I want to get divorced and take both children in my custody. How do I proceed and how much time will it take?

You can file for divorce on th grounds of cruelty and desertion as appears and also for custody of kids. However after knowing full facts exact grounds could be suggested. You may have phone consultation if so desire.

It all depends on what ground you want divorce. It could be based on cruelty, bigamy, Domestic violence etc. Otherwise you both together could apply for Divorce byway of mutual consent. Coming to the custody of children since mother is the natural guardian courts give custody to mother.

You have two ways to get relief.
1. By way of mutual consent i.e that both the parties agree to mutually to get divorce. If this is the case then you can mutually agree to some terms as they wish to. This kind of divorce is divided into two parts and this will take about 6 months.

2. By way of filing a petition of desertion.

As far as the custody of the children are concerned then a separate application will be filed

Well as per your quary you got married on 2011 and want diborc so there are two kind of divorce one mutual.and second when second party is not willing for divorce .you can file divorce petition.in family court generally mutual.consent it takes six month in total and in othet case there is no fix time limit drpenfd on effort of court as well as party in between you can file maintenance appli cation.also.now the question of vudtodu of your kids will also be decided by the court generally coury consider the welfsrebof child so that it can be decided further you can contact Mr for further ptocrrdinf

you can file a divorce case
however you will need a stong case on cruelity with bold allegations .
For custody of childeren , you need to form a statergy for the same
