Since your brother and his wife will complete one year of marriage in December. They are eligible to file for a mutual consent divorce. The procedure for the same is as follows:

Before filing for mutual consent divorce, the couple has to reach an understanding with regard to the terms and conditions of divorce in respect of maintenance amount, child custody, property division, etc. The petition for mutual consent divorce can be filed in the district family court any of the following places:

  • Place where marriage had taken place
  • Place where husband and wife last resided together.
  • Place where the wife is residing at the time of filing of the petition.

As per the Hindu Marriage Act, such petition can be moved jointly by both the parties under Section 13B of the Act on the grounds that the couple:

  • has been living separately for a period of one year or more,
  • has not been able to live together and
  • has mutually agreed that the marriage should be dissolved.

The Court shall then record the joint statement of the parties and pass a first motion order giving a time period of 6 months to the parties to resolve their dispute, but in case the parties are unable to resolve the issues within the stipulated time, the Court shall pass a decree of Divorce

Greetings,
For obtaining divorce you need to stay separate for atleast 1 year. Mutual Divorce Petition is required to be filed and other documents such as invitation card, wedding photograph, marriage certificate. In Petition you are required to mention the reason for mutual divorce and be specific while filing consent term. It requires 6 to 7 months time to get the decree.

First of all you may issue a legal notice against the concerned party. Thereafter you may file divorce petition under the relevant provisions as per your facts and story. Court will issue notice to the other side. On appearance otherside will file their written say. Then court will frame the issues. Matter will be shifted to hearing board. Wherein you will be allowed to give ur evidence and otherside will cross examine you. On completion of ir evidence otherside may give hos or her evidence.upon closing of evidence both sides will argue their case and court will pass it's final judgment. Entire process may take minimum six months to one year for conclusion.so far as charges are concerned it may vary from lawyer to lawyer.

After the expiry of one year they can file a petition for mutual divorce before the jurisdictional family court. But they need to mention in the petition that they were separated each other 1 year prior or otherwise it will be difficult to obtain the decree.
