Look, it is not a ground of disposal of a Criminal Case. In a Criminal Case the case may be dispose off if the Prosecution failed to submit evidence. then the Ld. Court will acquited the Accused on the ground of Non-prosecution. But Uncontested. I did not thinks so. Please apply for Certified copy of the Case and thereafter ask the question.

Well, Police has submitted Charge-sheet against your friend in some cognigible offences of Indian Penal Code and Ld. Magistrate took conigence of the same as triable case. Sec-307 of IPC i.e. attempt to murder is a Sessions triable offence. Therefore, Ld. Magistrate transferred the case (i.e. committed) to competent Sessions Court for Trial.
In the case of sessions, the first step is to submit the charge sheet in the CJM/ACJM court. The case is then sent to the Sessions Court for trial. As there was no objection to the CS, the case has been uncontested. It is now before the sessions court.
