I am hindu boy..my marriage was at surat(gujrat)as girl is from surat.girl has filed maintenance case from surat on me..i am resident of kolkata by birth also..can i file divorce case from kolkata
Under section 19 of the Hindu marriage act 1955 a petition for divorce can be filed in such court within the jurisdiction of which
1. The marriage took place
2. The respondent at the time of presenting the petition resides
3. The parties last resided together
4. The petitioner resides within the jurisdiction while presenting the petition, but the respondent resides outside the territory to which the Act extends.
