What do I need to pay if i I file for mutual divorce?

I got married about a year ago but things have become really bad. So bad, that it is difficult to stay together. It was a normal hindu wedding where no demand for dowry was made. Gifts from my wife's family came which included some jewellery, furniture and electrical appliances. No cash, nothing at all. It was offered as a gesture from my wife's famliy. She is qualified and has been earning a decent salary which is nearly Rs. 41000/- per month. All rituals went ahead with normal marriage expenses, as it happens in a typical middle class wedding. I dont really have any hard assets in my name except a car. I am also a working professional. How much do I need to pay if I file for mutual divorce? What will be the change in payment if it is not mutual?

There is no rule prevailing to fix an amount in Divorce by Mutual Consent. It's solely depends upon the parties...
Still in the above mentioned case as discussed, there should be an amount not exceed than Rs. 4-5 lacs as your wife is very well in earning.

Rest is depends on the mindset of your wife and her family members.

Dear Concerned - As you wife is working and earns a handsome salary - if protested you will not have to give any maintenance in case she file for maintenance or any interim financial relief. In case of Mutual DIvorce the finances would be decided on the basis of your mutual agreement with your wife.

Hi,
For mutual divorce your wife must agree for divorce. In the case she agrees, both of you need to file the case together. The terms and condition is mutually decided. In the case of contested divorce, it depends on the claims of your wife and how those claims has been established. There is no fixed formula for alimony even if wife claims x amount.

Under Hindu marriage act for mutual divorce both the party should be the willing .with that after filing divorce under mutual consent generally court grant a cooling period which may be reduced on exceptional grounds as recently decided ,but nonetheless this method consume less time and money ,whereas if you want to contest than it will take time .
Regarding alimony it's depend and vary as per case .For detail contact.

Legally you are not eligible for divorce, minimum 3 yrs post marriage require for divorce. In mutual u can ask if she needs any maintenance , if not mutual it will take long process maint. Will be based on ur salary
