What can be done if wife is already married

Hi, I have married in September 2015, now I came to know that my wife is already married and she left her husband a years ago without giving divorce. I don't want to file a case against her. But I want to get divorce from her.. Kindly suggest me the easiest way to get divorce from her...

You can file divorce in auch situation to claim your marriage null n void. You can also file a civil suit for declaration your marriage null and void but thats a lengthy procedure therefore petition under hindu maariage act is preferable

Dear Client you are hereby advised to file for anulment of your marriage as in India two marriages while the first husband is alive is called bigamy and is illegal in the eyes of law. Therefore you are advised to file an anulment of marriage instead of divorce which is a shorter process.

File the divorce on the basis of information you have shared . You can seek the indulgence of the court for granting of divorce on this very fact .

You dont have to do anything as your marriage with her was void ab initio. You can leave her when you want but keep the evidence that she was already married so that she cant claim maintenance from you.

She was already married so the marriage with you is voidable as per HMA you can file a petition in the court stating the marriage as nullity and a decree can be obtained for the same.Therefore divorce is not required for the same.
