how can I file for maintenance from my husband and what amount can I ask from my husband if he is earning good
As per the settled law, a wife can ask for 1/3 ratio from her husband if she is not earnig any thing. Apart from that, circumstances has to been seen before claiming maintenance amount, is there is any issue then amount can b increased

Maintence can be seek based on personal laws which governs you like the religion you follow. You can file petition under 125 crpc for maintenance and also under domestic violence . the quatam depends upon the earning ability of the husband and what he is earning right now also depends on your social status and way of your life.

You will have to file a divorce and move an application under section 125 maintenance. Accordingly the court will decide the maintenance for you. We can prove his income through affidavit. Further it depends on whta grounds are you taking divorce.
