want to apply for divorce on curilty ground

i m a male and want to apply for divorce on curilty ground, two yr of marraige . no child, my wife in her parent home, already all secondry attempt done.. like panchyati, she is harrasing my family and my mother and making unnecessory and uneassy practice, first tym we ll make make a mutual aggremt and she accepted her all mistake and come to my home but again repeated the same,, pls suggest all positive and negative points for me and my family

Yes u can file a divorce on a ground of cruelty and also on ground of desertion as u have mentioned in your query that she is living apart for two years.as far positive and negative point is concerned that we can talk over phone.

You can apply for divorce in your concerned family court.
On the ground of crulity,and others ground which will suit your case.
you have not stated whether the girl have filed any criminal case against you or your family like 498A.

You can approach the Court for divorce on cruelty ground stating all the facts regarding panchyati and your wife's undertaking. But pl. take note that court will not grant divorce outrightly. The court will ask mediation between you and your wife and if there will no conciliation , the court will grant divorce. Further , be ready for maintenance to your wife in case of divorce.

Regarding your query your positive ground of cruelty is strong because you have already tried best to restore your marriage but unfortunately she not understand your family and continuing her misbehaving which comes into cruelty and negative point is that she can fie maintenance case but your previous Panchayati and mutual agreement will defend you from in future if she file other criminal case if any.
