Sister's husband expired now she wants to remarry what procedure

25-Aug-2023 (In Divorce Law)
My sister is a muslim and her husband has been expired in 2009 and her son(15 Yrs) is having down syndrome She already got separated from her in-laws Now she wants to get remarried. She has some property and she is pretty sure that her in-laws will try their best to oppose the marriage and also they will try to take the control of the property if she gets remarried. Please let me know the legal matters that she needs to take care of before getting remarried and to keep her property with herself.

Dear sir/madam
The property which your sister is having is that a self acquired property or from which means she got that property and regarding the question of death of her husband and as per shariat she is having all the rights to marry the thing which you should be care full is your sisters in-laws can play game as her son who is suffering from disease is having all rights in her mothers property be sure your sister is only maintaining her son and keep all the records of his expenditure

Dear,

When the property stands in the name of your sister how can her inlaws interfere with her rights towards her property. She can remarry as per her wish as her husband expired and she is leaving independently since then..... You can contact me for further issues if any...

HI
any property in the name of a woman is her absolute property.
she can do whatever she wants with the property.
if you still want some additional safety factor, your sister can form a trust (before her second marriage) and have the property managed by the trust for the benefit of her son who is having down syndrome. that way her ex-laws cannot have any claim in the property.
