Rights of children & wife after divorce in husbands property

Dir sir I have 1three year son and 5year old daughter,my husband rental income is 80000.and a house of 1 cror.the house is named of my fatherinlow both are death.and also devaide.he wants divorce.but I not want same for children's future.plze suggest me after daivorce what is right of me and my son.his rental income and house.

After divorce you and your children are eligible for Maintainence from husband. If property belong to father in law then ur children has more right on it than your husband if it has not been transferred to ur husband.

Duty of your husband is to maintain you as his status and he is also liable to maintain your children and give him all facilities which is nessery if he is not ready you can file a suit for mantinance and file a civil suit on his property to create a charge

If you want divorce than your husband have to give alimony which is decided according to your husband source of income and standard of living .it is good that you don't want divorce so you and your husband make an agreement that if he wants divorce he have to give share in his property to you and your children and some amount of money for your survival

If you take divorce from your husband then you can claim alumni from his source of income and its also depend upon the court. You are entitled to get share from his moveable and immovable property earn by your husband.
The house is a ancestral property so you have not any right in it but your children both son and daughter are equally right in it.

अगर आप सहमति के आधार पर तलाक लेती हैं, तो यह आप दोनों पर निर्भर करता है कि आप लोग के मध्य इन सब बातों को लेकर क्या सहमति बनती है. ... और यदि इसके विपरीत तलाक यदि न्यायालय द्वारा गुण - दोष के आधार पर किया जाता है , तो आपके अधिवक्ता को धारा - 25 हिन्दू विवाह अधिनियम के अंतर्गत प्रार्थना पत्र देकर यह सब मांग करनी होगी , फिर वह न्यायालय के विवेकाधीन होगा कि वह क्या निर्णय देता है ।
