Rights of a wife staying apart on Hindu Undivided Family
22-May-2023 (In Divorce Law)
Does a Hindu woman who has been staying apart from her husband alongwith a minor son because of domestic violence, has any right over the HUF property of the Husband?
hello
fact are not clear in your question. you have not mention about that the woman is staying separate but you have not mention whether she is legally separate or living separate by her own?
if she living without divorce she can claim only maintenance from her husband but a minor son have the right in property of his ancestral property

Hello
You have all the right only against your husband but your son has all the right in HUF property. So if you wanted to claim any right in the HUF then file a case on behalf of your son.
Thanks

Yes she has right in the share of her husband and hence can also claim the same as the wife have share in the share of her husband which in the present case is possible since the property is Hindu undivided family property and every member of the family has his share in the same.
