Query regarding divorce and child custody

I got married in 2014dec as per hindu customs,presently housewife,after marriage gone through physical and verbal abuse by husband, in-laws not co-operative and constantly assassinating my character and dignity.Having son 2yrs old,in wat manner can I file my case for divorce (child maintenance) and child custody?

Hello, first of all u loged F.I.R against ur in laws under section 498 and domestic violence. After that u file a case under section 125 cr.p.c for maintenance and guardian wards act for child custody. May GOD help u in ur future and never hopeless in court openly orgue against ur in laws.

A divorce case can be filed by you on the ground of cruelty before the family court. You can also file a case for maintenance for yourself and for your son too. As far as the custody of the child is concerned, 2 year old baby is dependent on his natural guardian, that is mother. So you can keep your son with you.

You can file a case in family court for divorce under section 13, a. B. C .and of the Hindu marriage act 1955 .
With on affidavit of Hindu marriage act.
On the basis of mutual concerns under section 13 (B) Hindu marriage act and for child custody should be take because up to 8 year children Will be under mother custody under Gardenia's and warden act .you are also livable for mentinence.

u can file a case for her maiñtenance under125 crpc and for domestic violence under section 12 d.v.act. and for taking her son with u .u can file a case under hindu gurdiàn and mentinance act and the son is only 2 years old its ur legeal right to take son since 5 year old
