Procedure to file for divorce in India

I want know about the divorce procedures in Indian law.What are the first and foremost things an unemployed Indian woman has to consider before proceeding through divorce and also how to manage the kids custody in the whole matter.I have a 9 year old son and a boy and a girl who are twins and about 3 years old.

There are various ways by which the divorce proceedings can be initiated. Divorce proceedings can be initiated either the husband or the wife for reasons assigned in Hindu marriage Act or the Special marriage Act as the case may be. The first and foremost one needs to consider is that whether it is a actual case of divorce or not. Thereafter the best way to get divorce is "divorce through mutual consent" because that would not create ugly situations. In your case this would be the best option as you have three children and also unemployed. Your husband will have to give you maintenance from the very inception of the divorce proceedings. It will be very difficult for your husband to get the custody of the children. There are also other things which needs to be discussed one to one.
