Procedure to file a divorce and get joint custody of my child

My husband and I are seeking divorce because of compatibility and trust issues. We're married for 5 years and have 1.5 year old kid. I want joint custody for child and would like to know the procedure of divorce.

If you and your husband have arrived at a understanding regarding matters of alimony, maintenance and custody of child then all you have to do is to file for MC divorce in the jurisdictional court. I can help in this matter .

You and your husband can file a Joint petition for Divorce by Mutual Consent. During this, a settlement agreement will be entered into outlining your relationship post divorce and you may include custody clauses in this. Typically, we also include clauses for joint bank accounts, property held jointly and other details pertaining to your marriage and family. The joint petition will be filed in the Family Court and require the following documents: (1) Marriage Invitation/ Marriage Registration Certificate; (2) Marriage Photograph; (3) Birth certificate of the child; (4) Photo and Adress proof of both husband and wife; and any other documents that you may want the Court to take notice of. It is unclear as to what religion you belong to as there are some personal-law specific procedures as well (Hindu Marriage Act, Indian Marriage Act, Special Marriage etc.)

Consult and discuss briefly and file an appropriate suit for mutual and child joint custody, terms and conditions etc., consult and representing in the court and get early decree. You may have to present the court at the time of filing.
