Procedure of divorce according to Hindu marriage act

12-Jan-2023 (In Divorce Law)
I am working in Bangalore but want to file divorce from my home town (Uttar Pradesh). I know mostly the whole process takes around 6 months. Just wanted to know how many times I have to visit court in a month during the whole divorce process. Please advice whether I should file divorce from Bangalore or from my home town so that it should not hamper my job. Me and my spouse both are hindu and got married by hindu rituals but my marriage is not registered. Your advice will be very helpful.

Hi, you can file at either places, but it is better u file here itself in Bangalore so that it will be convenient for u as it doesn't affect on ur job too.. But you should have local address proof like voter Id, Aadhar, DL, passport, bank account statement etc., If you go for mutual you have to be present only twice...
Please contact me for further assistance..
Thank you

As you are currently residing and working in Bangalore, it is better to file for the divorce case in Bangalore to avoid frequent travels to your native place. If the divorce is by mutual consent, it will take less time. If the divorce is contested one it will take a time.

Hello,

Since you are staying in bangalore its better to file for divorce here itself. The duration of case cannot be predicted or how many times your case may fall in a month Please feel free to contact. Will suggest have a face to face discussion thats better.

If you are residing in Bangalore and have a local address proof, it is recommended to file it here as it will be easier for you to travel to Court when required. The 6-month timeline is for divorce by mutual consent only, meaning when both husband and wife want to divorce each other in an amicable manner and both file a joint petition, then it takes about 6-6.5 months. If your husband is not in agreement, then it can take more than 1 year. You can file a case in Bangalore only if you have local address proof (lease agreement, govt issued id proof). Non-registration of marriage does not hamper the case.
