Procedure for mutual consent divorce

What are the steps for a Mutual consented divorce if both the husband and wife after 10 years of marriage and 2 kids feel that now, they have grown apart further and there is no love between them.The wife is a house wife is not working and the Kids are 8 years and 4 years old. From a financial viewpoint the husband is OK to support both the kids education so that the kids have a best education possible. What other points need to be considered to make it a very amicable separation.

The couple can engage a single Advocate and discuss the entire terms of settlement, which can be enunciated in the petition for mutual consent divorce. Thereafter the Petition has to be filed in the court, wherein both parties presence is required. At the time of filing the petition address proof of both parties is compulsory to be annexed to the petition. Subsequent to that a date will be given for appearance of both parties. On the said date the matter will be referred to mediation and if the terms are mutually agreed upon, the Mediator will draw the Memorandum of Settlement Agreement which will be duly signed by both parties and the Advocate. The said Agreement with the file will be sent back to the Court and on going through the same and confirming the contents of the Agreement with the parties, the Court will pass the order.

Primary thing is that how much support you can give to the wife and children and there should be a commitment before the court, with an understanding you can apply for divorce, even there may be contest when applied. you should be ready for any eventuality

It's very unfortunate that even after 10 years of marriage this problem arose , my personal view being a PSychiatric counsellor and psychotherapist is try family counsellor first , in difficulty can consult us , if nothing still works then u can consult us it can be done easily , without much stress . ofc : dr pankaj kumar , Advocate .

You can file a divorce petition by mutual consent if both of you have come to the conclusion that you have not been able to live together. Both parties must agree that the marriage should be dissolved. Both parties must apply to the District Court not earlier than six months and not later than 18 months after that date the petition may be heard and the Decree of Divorce dissolving the marriage may be granted. The rest depends on the facts and circumstances.

Yes, you can file for divorce by mutual consent. Once the petition is filed, you need to wait until 6 months for Decree. You will also have an opportunity to withdraw the case.

As per your query if you couple both are ready for mutual divorce, you both can approach before court for decree for mutual divorce, it will take six to seven months to obtain decree of divorce.

Its simple file mutual consent divorce you both can engage one advocate and after that if both parties have no objections to grant the divorce the court will grant it and when both have agreed the court will grant the decree of divorce thereafter you can also get married if he has also obtained divorce.
