Procedure for divorce if marriage is not registered.

Friend of mine want to get divorce but her marriage never get legally documented.In that case does she require to apply for divorce.If yes please let me know if there is any procedure to get help from government for females in case of divorce

Yes she can apply for divorce but she has to satosfy couet that she is married with that guy and their marriage was oerformed with rituals and ceremonies otherwise thre will b problem for her. There is

You have not given the details of the marriage whether the necessary ceremonies of the marriage were performed or not. If the necessary ceremonies were performed and the marriage was duly consummated you will to file for divorce as per the law , so there is no straightjacket formula by which you can get the divorce even with the government intervenes. So there you need to provide few more details e.g. the religion of the parties , the reason of separation etc..

Whether marriage registered or not, marriage can be dissolved by contested or mutual divorce. There is required only proof of marriage like card photograp etc.
Mutual is easy way if both parties agreed.

It is necessary to check whether the husband has mentioned the name of the lady as his wife. I would suggest to take a divorce first even if its not registered as Non-registration of marriage alone does not nullify married state.

Even if the marriage is not registered, you have to seek divorce by filing a divorce petition before the family court. She can claim maintenance from her husband if she is not able to maintain herself. Revert me. All the best.

Non-registration of marriage does not nullify marriage. If the couple have lived together with intention and purpose and meaning of marriage then they are considered as married couple.Even under live-in-relationship, there are some beneficial rights for the woman and children born out of such relationship, which has no legal binding.without a legal divorce one can face problems in future. So, it is always better to go for legal divorce. It may be mutual divorce or any of the party of the couple can file divorce petition before the court.
