My sister's divorce case is in counter stage. What is counter stage? And the next hearing is next month.what she should do next? When will she get the divorce?

Counter statement means it is a reply statement to the petition filed by her husband. In counter statement you have to rrefuse false allegations made against her and may state the real facts of the case. If you filed counter on next hearing then the matter will post for trial to examine the witnesses on both the side.To complete all the proceess Atleast it will take one year. I could understand that this case has been filed by your brother in-law. she has to file counter statement for his allegations. generally petition filled with allegations about other party. .

The counter is the version filed by the respondent stating the reasons why the divorce should not be granted by the court. I guess your sister has filed the case. If it so, her husband will deny her allegations and state the reason to dismiss the petition.

When the case is in counter stage, the respondent husband has to file counter. If the counter is for IA filed then after filing the counter there will be inquiry (argument) . After the completion of both sides argument trial will commence. For further for more details contact me.

Counter stage means that her husband has to file his objections/counter to state that your sister is not entitled to get divorce from the Court. Most probably the husband may not file his counter in the next hearing date. After 1 - 2 more hearing dates the husband may file his counter. Thereafter the court will put the case for giving evidence by your sister and after that the husband's Lawyer will cross examine your sister. Then your sister may put the evidence of any other witness and again the husband's Lawyer will cross examine the witness. After your sister has given all the evidence the husband will give his evidence and your sister's Lawyer will cross examine them. After that both the Lawyers will argue the case. Minimum it will take 6 - 10 hearings for the case to get over depending upon the Judge. So may be another 6 months atleast.
