Physical and mentally torture from husband and in laws

, I am married I have 2 kids, I am suffering a mental and physical torcher from my husband and his family members, there was a warning from police station but still continues to do more please advise me should I be live with them or come out! what law says if I leave my family and will law give my kids to my custody till court decision if they demand for divorce
Assuming you are Hindus,
If you are facing mental and physical cruelty by the hands of your in laws you can move out of the family along with you kids.
Thereafter, your husband would be required to file a case for the custody of the kids.
However, as per the recent Supreme Court judgment, the custody of the children remain with the mother till the children have attained age of 5 years.
